1. Acceptance of Terms

Welcome to L'amico: Language Friend ("L'amico," "we," "our," or "the app"). By accessing or using our mobile application, you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and L'amico.

If you do not agree to these Terms, you must not access or use the app.

2. Eligibility

We reserve the right to verify your age at any time. If we discover that you are under 18, we will immediately terminate your account and delete your data.

3. Account Registration

To use L'amico, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate and current
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or provide false information.

4. Acceptable Use

4.1 You Agree To:

• Use L'amico for language learning and practice purposes only
• Treat other users with respect and courtesy
• Provide honest ratings and feedback
• Report inappropriate behavior or content
• Comply with all applicable laws and regulations

4.2 You Agree NOT To:

• Harassment: Harass, bully, threaten, or intimidate other users
• Hate Speech: Use discriminatory, racist, sexist, or hateful language
• Sexual Content: Share sexually explicit content or engage in sexual harassment
• Spam: Send unsolicited messages or promotional content
• Impersonation: Impersonate another person or entity
• False Information: Provide false or misleading information
• Abuse: Abuse the matching system, rating system, or reporting system
• Commercial Use: Use the app for commercial purposes without our permission
• Automated Access: Use bots, scrapers, or automated tools to access the app
• Reverse Engineering: Reverse engineer, decompile, or disassemble the app
• Security Violations: Attempt to gain unauthorized access to our systems
• Illegal Activities: Use the app for any illegal purpose

5. User Content

5.1 Your Content

You retain ownership of content you submit to L'amico (profile information, ratings, feedback). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content for the purpose of operating and improving the app.

5.2 Content Standards

All user content must:

• Be appropriate for a language learning environment
• Not violate any laws or third-party rights
• Not contain malicious code or viruses
• Not infringe on intellectual property rights

5.3 Content Moderation

We reserve the right to review, remove, or modify any user content that violates these Terms or is otherwise objectionable. We are not responsible for user-generated content.

6. Calls and Communication

6.1 Call Recording

We do NOT record your calls. All calls are peer-to-peer audio connections. We do not store, monitor, or analyze call audio content.

6.2 Call Conduct

During calls, you must:

• Maintain a respectful and professional demeanor
• Focus on language learning and practice
• Not engage in inappropriate, offensive, or illegal behavior
• End the call immediately if you feel uncomfortable

6.3 Reporting Issues

If you experience harassment, inappropriate behavior, or technical issues during a call, please report it immediately using the in-app reporting feature.

7. Matching System

Our matching system connects you with other users based on:

• Language compatibility (native and target languages)
• Language level preferences
• Shared interests and motivation
• Availability status

We do not guarantee that you will be matched with a specific user or that matches will meet your expectations. You can end any call at any time.

8. Rating and Ranking System

After each call, you can rate your partner (1-5 stars). Ratings are used to:

• Calculate average ratings displayed on user profiles
• Generate weekly and all-time rankings
• Improve matching quality

You agree to provide honest, fair ratings. Abusing the rating system (e.g., giving unfair low ratings) may result in account suspension.

9. Subscription and Payments

9.1 Free Tier

The free tier includes:

• 80 minutes of calls per day
• Maximum 20 minutes per call
• Access to all core features

9.2 Premium Tier (When Available)

The premium tier ($4.99/month) includes:

• Unlimited call minutes per day
• Unlimited call duration
• No advertisements

9.3 Billing

Subscriptions are billed monthly through Google Play Store. You can cancel at any time. Cancellations take effect at the end of the current billing period. No refunds for partial months.

10. Blocking and Reporting

10.1 Blocking Users

You can block any user at any time. Blocked users:

• Cannot call you or match with you
• Cannot send you friend requests
• Cannot view your profile

10.2 Reporting Users

You can report users for:

• Harassment or abusive behavior
• Inappropriate content
• Spam or commercial solicitation
• Underage users
• Other violations of these Terms

We investigate all reports and may take action including warnings, suspensions, or permanent bans.

11. Account Suspension and Termination

11.1 Our Right to Suspend or Terminate

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abusive behavior toward other users
• Multiple user reports
• Being under 18 years of age
• Any other reason we deem appropriate

11.2 Your Right to Terminate

You can delete your account at any time by contacting [email protected]. Your data will be deleted within 30 days (see our Privacy Policy).

12. Intellectual Property

L'amico and all related content, features, and functionality are owned by us and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute the app or its content
• Use our trademarks or branding without permission
• Create derivative works based on the app
• Remove or alter any copyright notices

13. Disclaimers

13.1 No Warranty

L'amico is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Accuracy, reliability, or availability of the app
• Uninterrupted or error-free operation
• Security or freedom from viruses

13.2 No Guarantee of Results

We do not guarantee that using L'amico will improve your language skills or achieve any specific learning outcomes.

13.3 Third-Party Services

L'amico uses third-party services (Firebase, Twilio, etc.). We are not responsible for their availability, performance, or privacy practices.

14. Limitation of Liability

To the maximum extent permitted by law, L'amico and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or use
• Personal injury or emotional distress
• Unauthorized access to your account
• Errors or omissions in content
• Interactions with other users

Our total liability shall not exceed the amount you paid us in the past 12 months (or $100 if you have not paid us anything).

15. Indemnification

You agree to indemnify, defend, and hold harmless L'amico and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the app
• Your violation of these Terms
• Your violation of any third-party rights
• Your content or conduct

16. Dispute Resolution

16.1 Informal Resolution

Before filing a legal claim, you agree to contact us at [email protected] to attempt to resolve the dispute informally.

16.2 Arbitration

16.2 Jurisdiction

Any legal disputes shall be resolved in the courts of the courts of Milan, Italy.

16.3 Governing Law

These Terms are governed by the laws of Italy, without regard to conflict of law principles.

17. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via:

• In-app notification
• Email to your registered address
• Updated "Last Updated" date at the top of this page

Continued use of the app after changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the app and delete your account.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and L'amico regarding your use of the app.

20. No Waiver

Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or any other provision.
